Employment Law - Wrongful Termination Screening
Minnesota is an at-will employment state. That means you may be terminated for any reason or no reason whatsoever. (You may also quit your job for any reason or no reason whatsoever.) There are exceptions to this rule, however.
Please read all six (6) questions below:
Did you have a signed written contract with your employer? A job application is not enough.
Do you have evidence an employer discriminated against you because of your:
race
color
creed
religion
national origin
sex
gender identity
age
disability
marital status
status with regard to public assistance
sexual orientation, or
familial status
Good evidence may include emails, letters, text messages, videos, audios, etc. Witness testimony is ok but not the best.
Do you have evidence your employer retaliated against you after you, in good faith, reported or opposed an unlawful practice or policy? Good evidence may include emails, letters, text messages, videos, audios, etc. Witness testimony is ok but not the best.
Did your employer terminate you after you, in good faith, asserted your rights or requested something you are entitled to by law? By way of example, this may be your requesting workers’ compensation benefits, paid time off (depending your jurisdiction). family leave, medical leave, military leave.
Do you have evidence of your employer stating your job position was permanent or that you could not be terminated? Good evidence may include emails, letters, text messages, videos, audios, etc. Witness testimony is ok but not the best.
Do you have evidence your employer subjected you to intolerable working conditions that affected your ability to perform your job? Being simply rude or mean is not enough.
